If you decline these license conditions, you must destroy all your copies of this program package. accsis GmbH ("accsis" in the following text) grants the right to use the AMETAS software package (the "software") as well as the AMETAS API and User's Guide documentation (the "documentation") to the licensee based on the following conditions. The software may only be used for educational or research purpose. The software is provided on an as-is basis and is herewith explicitely declared to be experimental. The licensee takes all responsibility for the application of the software. This license only covers the packages and classes of the AMETAS core agent system. Software dependend on the core classes support (the so-called Place Users) that has been developed for usage with the AMETAS system is not a part of AMETAS and will not be covered by this license. Validity period of this license ---------------------------------- This license granting the right to use the software on the current version level for educational and research purpose is not limited in time. 2. Granting the license ----------------------- (A) Rights The licensee receives an intransferable and inalienable license to install this software on an unlimited amount of computer systems as long as the usage is restricted to educational and research purposes. The licensee is allowed to create an unlimited number of copies of the software for archival purposes. Copyright notes and license terms must not be removed. (B) Restrictions All rights not explicitely noted here remain reserved. Usage, copying, modification, and transfer of the software are only allowed under the conditions stated in this license agreement. The licensee is not allowed to transfer all or parts of the software in another representation uncommon to the Java runtime environment, especially by decompiling, disassembling, reverse-engineering or any other way to retrieve an analyzable format for humans or algorithms outside the runtime environment. The software may not be lent or rent, sold or distributed by the licensee. (C) Experimental state of the software The licensee acknowledges that the software has experimental state. It can contain flaws or insufficiencies that may hinder or prevent an application execution based on the software. accsis does not commit in any kind to correct any such flaws, errors or insufficiencies in the code of the software. Furthermore, accsis does not commit in any kind to issue the software outside of this license agreement. (D) Responsibilities of the licensee The licensee releases accsis of any responsibility or commitment that may result by applying the software. The licensee is responsible to ensure the integrity of his copy of the software. The licensee is responsible for protecting cryptographical keys used in the AMETAS core and application environment. (E) Usage of the software in critical areas The software must not be used in critical areas like air traffic control, aircraft control, hospitals, or nuclear facilities. accsis does not take any responsibility for consequences of the usage of the software in these areas. Specifically, accsis does not take any responsibility for damage caused in these areas by using the software. 3. Copyright ------------ The software is protected as intellectual property of the authors under copyright of accsis GmbH. The licensee is granted a license to use his/her copy of the software. Redistribution is not allowed without prior consent of accsis GmbH. 4. Termination -------------- (A) The licensee may decline this license at any time. The licensee must then dispose of any copies, including backups, of the software and the documentation. (B) This license is void if the licensee does not agree to or abide by all conditions mentioned in this license. The license is then considered ungranted. (C) On termination of the license, the licensee must dispose of any copies, including backups, of the software and the documentation. 5. No warranty -------------- The software is provided on an as-is quality basis with no warranty to be free from errors or insufficiencies for the intended application. 6. Maintenance and support -------------------------- accsis does not take any responsibility to maintain the software or provide support for the licensee. Furthermore, there is no obligation for accsis to issue update versions (updates) or software corrective facilities (bugfixes). The licensee is entitled and encouraged to acquire updates and bugfixes as soon as possible after those facilities have been published by accsis. The software, modified by applying the updates and bugfixes, is considered to be the same product and remains under the conditions of this license as long as the updates and bugfixes originate from accsis. The application of updates and bugfixes from other origins terminates this license. 7. Modification of license terms -------------------------------- This license may be overruled by specific agreements between accsis and the licensee, based on a written contract between both parties. All parts of the license not covered by the contract remain valid. accsis reserves the right to modify the license terms if necessary. These modifications only affect new licenses not yet granted. Granted licenses remain valid in their previous contents.
